1. Introduction

These Terms of Service ("Terms") govern the contractual relationship between the operator of the Beautis service (the "Operator") and individuals or legal entities that have entered into an agreement to use the Beautis service (the "Customer").

Beautis is a cloud-based SaaS platform for managing beauty salons, hair salons, and similar businesses, available at beautis.eu.

By completing registration, the Customer confirms they have read these Terms and agree to be bound by them.

2. Formation of Agreement

The service agreement is formed when the Customer completes registration and account activation in the Beautis system, or upon payment of the first licence fee.

The Customer must be an individual of legal age with full legal capacity, or a duly authorised legal entity.

3. Service Description and Licence Plans

The Operator grants the Customer access to the Beautis platform as a non-exclusive, non-transferable licence within the scope of the chosen plan.

Available plans and their limits are published at beautis.eu. The Operator reserves the right to adjust plan limits with at least 30 days' notice to the Customer before any change takes effect.

4. Pricing and Payment

Licence prices are listed on beautis.eu in Czech Koruna (CZK), inclusive of any applicable VAT (the Operator is not a VAT payer).

Payment is made by bank transfer based on a payment instruction sent to the Customer. Each order receives a unique variable symbol. Payment must be credited to the Operator's account within 14 days of the instruction being issued, otherwise the order lapses.

Annual billing is available at a reduced rate as shown in the current price list; the full annual amount is due in advance.

SMS credits are consumed as messages are sent. The per-SMS price is stated on beautis.eu.

5. Term and Licence Renewal

The agreement is concluded for a fixed term corresponding to the chosen billing period (monthly or annual). Upon expiry the Customer receives a renewal notice. If payment is not received within 7 days after licence expiry (grace period), access to paid features is restricted.

The Customer may end the agreement at any time by not renewing. Fees paid for the current period are non-refundable.

8. Data Protection and GDPR

The Customer acts as the data controller in respect of their clients' personal data; the Operator acts as the processor. Processing conditions are set out in the Privacy Policy.

9. Liability

The Operator is not liable for damages caused by internet outages, third-party failures (SMS gateway, bank), force majeure, or indirect losses (loss of profit). The Operator's total liability for any damages arising in connection with the service is limited to the licence fees paid by the Customer in the last 3 months.

11. Changes to Terms

The Operator may update these Terms at any time. The Customer will be notified by e-mail or in-app notice at least 30 days before changes take effect. If the Customer does not accept the changes, they may terminate the agreement before the effective date.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Czech Republic. Disputes will be resolved preferably by amicable means. The courts with jurisdiction are those at the Operator's place of business (Prague, Czech Republic). Consumers also have the right to contact the Czech Trade Inspection Authority (coi.cz) as an out-of-court dispute resolution body.

13. Final Provisions

These Terms take effect on 1 September 2026. If any provision is found invalid or unenforceable, the remaining provisions remain in full force.
